Colby - Terms of Service
These Terms of Service apply to your use of Colby, Collab’s AI-powered tenant assistant.
By using Colby, you agree to these Terms. If you do not agree, please do not use Colby.
“Collab,” “we,” “us,” and “our” refer to Collab Z Inc. and its affiliated property management entities.
1. Nature of the Service
Colby is an AI-powered tenant assistant designed to help residents with property-related support.
Colby may help with:
- Common property questions
- Non-emergency maintenance requests
- Tenant communication
- Routing questions to the right Collab team member
- General support related to your property
Colby is meant to make tenant support faster and easier. It does not replace your lease, official Collab notices, emergency procedures, or existing property management systems.
2. Access and Verification
Colby may be accessed through supported messaging channels, including WhatsApp, Telegram, and SMS.
To use Colby, you may need to message Colby first. Colby may then verify your identity by sending a one-time passcode to the email address associated with your lease or tenant profile.
You agree not to:
- Use another person’s phone number, email, or account
- Share your verification code with others
- Try to access another tenant’s information
- Misrepresent your identity or unit
Message and data rates may apply when using SMS, WhatsApp, Telegram, or other messaging services.
3. Not Professional Advice
Colby provides general informational support only.
Colby does not provide:
- Legal advice
- Financial advice
- Tax advice
- Brokerage advice
- Medical, safety, or emergency advice
- Professional repair, inspection, engineering, or construction advice
For legal, financial, emergency, or professional matters, please contact the appropriate qualified professional or emergency service.
4. AI-Generated Content
Colby uses artificial intelligence to generate responses.
AI-generated responses may sometimes be incomplete, inaccurate, outdated, or misunderstood. You should verify important information before relying on it.
Collab may review, correct, update, or override Colby’s responses when needed.
5. Lease and Property Information
Colby may provide general information about your property, lease process, maintenance process, or Collab support process.
However:
- Your signed lease and official written notices control over anything Colby says.
- Colby does not change your lease.
- Colby does not waive rent, fees, rules, or lease obligations.
- Colby does not create rent credits, concessions, approvals, or legal rights unless confirmed in writing by an authorized Collab representative.
If Colby says something that conflicts with your lease, Resident Center, Buildium, or written communication from Collab, please contact Collab for clarification.
6. Maintenance Requests
Colby may help collect information about non-emergency maintenance issues.
When you submit a maintenance request through Colby, you agree to provide accurate information about the issue, including location, description, urgency, and photos if requested.
Submitting a request through Colby does not guarantee:
- Immediate service
- Same-day repair
- A specific appointment time
- A specific contractor
- A rent credit or reimbursement
- Completion within a specific timeframe
Collab may review, route, update, or convert Colby-submitted maintenance information into an official service request.
7. Rent Payments and Financial Information
Rent payments are not currently available through Colby.
Please continue to use Resident Center or the normal Collab-approved payment process for rent payments.
Do not send Colby:
- Payment card numbers
- Bank account details
- Social Security numbers
- Passwords
- Sensitive financial information
Any information Colby provides about rent, balances, credits, charges, or payments is for general guidance only and should be verified through the official payment system or Collab staff.
8. Emergencies and Urgent Issues
Colby is not an emergency response service.
Do not use Colby for life, safety, medical, fire, police, gas leak, active break-in, flooding, severe electrical hazards, or other emergencies.
For life or safety emergencies, call 911 immediately.
For urgent maintenance, use the existing urgent maintenance process provided by Collab or your property.
9. Communications
Colby may help draft, send, route, or summarize tenant communications.
Colby does not make binding commitments or agreements on behalf of Collab unless confirmed in writing by an authorized Collab representative.
By using Colby, you agree that Collab may communicate with you through the channel you use, including WhatsApp, Telegram, SMS, email, or other supported channels.
Your use of third-party messaging services may also be subject to their own terms and privacy policies.
10. User Responsibilities
By using Colby, you agree to:
- Provide accurate information
- Use Colby only for lawful tenant-support purposes
- Review important information before acting on it
- Use official channels for rent payments
- Use emergency channels for emergencies
- Avoid sending sensitive personal or financial information
- Report inaccurate, unsafe, or concerning responses
- Communicate respectfully
You may not misuse Colby, submit false requests, impersonate others, access another tenant’s information, upload harmful content, or interfere with Collab systems.
11. Privacy and Service Improvement
Collab may review Colby conversations and related data to:
- Respond to tenant requests
- Improve Colby
- Troubleshoot technical issues
- Route maintenance or support requests
- Monitor safety and quality
- Improve property operations
Colby may process information such as your name, email, phone number, property, unit, messages, photos, maintenance details, verification events, and usage information.
Your use of Colby is also subject to Collab’s Privacy Policy.
12. Service Availability
Colby is provided “as is” and “as available.”
Collab does not guarantee that Colby will always be available, error-free, secure, or able to resolve every request.
Collab may update, modify, suspend, or discontinue Colby at any time.
13. Limitation of Liability
To the fullest extent permitted by law, Collab and its affiliates, officers, employees, contractors, vendors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Colby.
This includes damages related to:
- AI-generated responses
- Incorrect or incomplete information
- Maintenance requests
- Delayed messages
- Third-party messaging issues
- Rent or payment confusion
- Lease or property decisions
- Emergency situations where Colby was used instead of proper emergency channels
To the fullest extent permitted by law, Collab’s total liability related to Colby will not exceed the amount you paid to use Colby, if any.
14. Indemnification
You agree to indemnify and hold harmless Collab, its affiliates, officers, employees, contractors, vendors, and service providers from claims, losses, damages, or expenses arising from:
- Your use or misuse of Colby
- Your violation of these Terms
- Your submission of false or unauthorized information
- Your attempt to access another person’s information
- Your violation of applicable law
15. Changes to These Terms
Collab may update these Terms from time to time.
If we update the Terms, we may change the “Last updated” date above. Continued use of Colby after the Terms are updated means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
